Section Spotlight Frances Ross Nolan, Esquire Section Spotlight THE ADR SECTION Th e Birmingham Bar Association is excited about the work that the Alternative Dispute Resolution Section is doing this year. Th e ADR Section promotes all forms of alternative dispute resolution: Arbitration, Collaborative Law, Mediation, and Private Judging. Th rough CLE seminars, training high school students to resolve disputes through alternative methods, and other educational events, the ADR Section carries out its mission of furthering the role of alternative dispute resolution methods among attorneys, judges, litigants, the public and businesses. Collaborative Law is a growing area in the ADR fi eld, and the Birmingham Bar Association has a Collaborative Law Committee, which is expanding as it spreads its message. Frances Nolan, who authored the article below, is chair of the Collaborative Law Committee and a member of the ADR Section Executive Board. Frances and her committee recently joined together with the Birmingham Collaborative Alliance to sponsor a 2-day Interdisciplinary Collaborative Practice Basic Training that met the International Academy of Collaborative Professionals standards for collaborative law. Frances' article gives readers an informative overview of this expanding area of law. COLLABORATIVE LAW/ COLLABORATIVE PRACTICE If you are reading this article, you may be wondering as you begin, “What is collaborative about the practice of law?” After all, ours is an adversary system employing (at least) two hired guns in each case to present/sell opposing views to a judge or jury who will make a fi nal determination, right? Or in the event of a negotiated resolution, to bargain opposing positions in an eff ort to “win” the best outcome for our client? While that is the way things have traditionally been, there is now an alternative to that approach; a non-adversarial one known as Collaborative Law. 24 Birmingham Bar Association
